Who is the controller of your personal data?

JANDERSKIN, S.L. is the Controller of the USER’s personal data and informs him/her that these data shall be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018 of 5 December (LOPDGDD).

For what purpose do we process your personal data and why do we do it?

Depending on the form from which we have obtained the personal data, we will process it confidentially for the following purposes:

In the form User register

Manage the user’s account in order to provide personalised access to the website and the interactive services offered. (by the consent of the interested party, 6.1.a GDPR.

In the form E-commerce

Manage the purchase or online order, process the payment and proceed with the shipment or activation of the same, based on the general contracting conditions.

These communications will be made by the controller and will be related to their products and services, or those of their partners or suppliers with whom they have reached a promotion agreement. In this case, the third parties will never have access to personal data.

For how long will we keep your personal data?

Data shall be stored for no longer than is necessary to maintain the purpose of the processing or for as long as there are legal prescriptions dictating their custody, and when such purpose is no longer necessary the data shall be erased with appropriate security measures to ensure the anonymization of the data or their complete destruction.

To whom do we disclose your personal data?

Data disclosure to third parties:Personal delivery data is expected to be communicated to the transport companies and logistics operators responsible for the physical delivery of the cosmetic products in the destination countries.
Likewise, data may be disclosed to banking entities and payment gateways necessary for processing financial transactions. No further transfers to third parties will be carried out except under a legal obligation, or to our technological service providers under data processing agreements (Art. 28 GDPR).

International data transfers:The data controller uses software tools and technological services for e-commerce management, cloud storage, and marketing whose providers may be located or store data outside the European Economic Area (EEA). The data controller guarantees that these transfers are carried out solely to countries that hold
an Adequacy Decision from the European Commission or, failing that, are regulated through legal instruments that provide adequate safeguards equivalent to the European standard, such as Standard Contractual Clauses (SCCs) or adherence to certified international privacy frameworks (such as the Data Privacy Framework). What are your rights?

The rights of the USER are:
Right to withdraw consent at any time.
Right of access, rectification, portability and erasure of your data and the limitation or objection to their processing.
The right to file a claim with the Spanish Supervisory Authority (www.aepd.es) if you consider that the processing does not comply with the current legislation.

What happens to the data of minors and individuals who require support measures for their legal capacity?

The services, products, and registration options offered through this website and our associated social networks are directed exclusively to persons of legal age or to minors who have reached the minimum legal age to provide autonomous consent under the laws of their country of residence (set at 14 years in Spain and up to 16 years in other European Union Member States). The CONTROLLER does not knowingly collect or process data from minors below this legal threshold. If the USER is under said age, they are strictly prohibited from registering, purchasing, or using the brand’s channels without the express supervision and authorization of their parents or legal guardians.
Furthermore, if the user requires support measures to exercise their legal capacity, the intervention and consent of their duly authorized legal representative or guardian shall be required. The CONTROLLER shall be expressly exempt from any liability arising from the use of the website or social networks by individuals who fail to meet these capacity requirements, and will proceed to immediately delete the data upon detecting any such non-compliance.

2. SOCIAL MEDIA AND EXTERNAL REVIEW PLATFORMS

By following our profile on social networks, the user consents to the processing of their personal data in accordance with the privacy policies of the respective platform. JANDERSKIN, S.L. will have access to and will process the public information of the user’s profile, in particular, their contact name and the interactions they perform. The processing of these data will be carried out based on the user’s consent and with the sole purpose of keeping them informed about JANDER SKIN’s news, products, and activities within the social network itself. In accordance with Regulation (EU) 2016/679 (GDPR), we inform you that the collected data will be integrated into the
CONTROLLER’s processing system. JANDERSKIN, S.L. will not extract these data from the social network nor create independent databases with them without additional explicit consent. Reviews and Rating Platforms: This website displays ratings and information originating from the external platform Trustpilot to demonstrate the quality of our cosmetic products. By publishing a review on said platform, the user is aware that their username, alias, or public avatar may be visible on our website through integration tools. The processing of these data is strictly limited to displaying the original review and is governed by Trustpilot’s terms of use and privacy policy; the CONTROLLER disclaims any liability regarding account management on said external platform.
The publication of comments and content on our corporate profiles or associated review platforms becomes public information; therefore, users must exercise special caution when sharing their personal information. JANDERSKIN, S.L. is not responsible for the information that users voluntarily incorporate. However, any person whose personal data appears published in the comments or integrations may request its removal through the general contact channels indicated in this policy. The user can autonomously restrict access to their data by configuring the privacy settings of their own account directly on the respective social network or platform.

3. COMPULSORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

The USERS, by marking the corresponding boxes and entering data in the fields, marked with an asterisk (*) in the contact form or download forms, accept expressly and in a free and unequivocal way that their data are necessary for the supplier to meet their request, voluntarily providing their data in the remaining fields. The USER ensures that the personal data provided to the CONTROLLER are true and is responsible for communicating any changes to them. The CONTROLLER informs that all data requested through the website are mandatory, as they are necessary for the provision of an optimal service to the USER. In the event that not all of the data is provided, there is no guarantee that the information and services provided will be completely adapted to
the User’s needs.

4. SECURITY MEASURES

That in accordance with the provisions of the current regulations on the protection of personal data, the CONTROLLER is complying with all the provisions of the GDPR and LOPDGDD regulations for processing the personal data for which they are responsible, and is manifestly complying with the principles described in Article 5 of the GDPR, by which they are processed in a lawful, fair and transparent manner in relation to the data subject and appropriate, relevant and limited to what is necessary in relation to the
purposes for which they are processed. The CONTROLLER guarantees that all appropriate technical and organisational policies have been implemented to apply the security measures established by GDPR and LOPDGDD in order to protect the
rights and freedoms of the USERS, and has communicated the appropriate information for them to be able to exercise their rights and freedoms.
